Terms of Service

1. Acceptance of Terms

By accessing or using the WooFur platform ("WooFur", "we", "us", or "our"), including our website, mobile applications, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. The Service

WooFur is a marketplace that connects pet owners ("Pet Parents") with independent pet care facilities and providers ("Facilities") offering services such as daycare, boarding, grooming, and training. WooFur also provides facility management tools to Facilities.

WooFur is not itself a pet care provider and does not employ the Facilities. We do not control the quality, safety, or legality of the services provided by Facilities, and we are not a party to any booking agreement between Pet Parents and Facilities.

3. Accounts

You must create an account to use most features of the Service. You agree to provide accurate, current, and complete information, including a valid phone number, and to keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You must be at least 18 years old to create an account or make a booking.

4. Bookings, Cancellations, and Payments

Bookings made through the Service are agreements directly between the Pet Parent and the Facility. Each Facility sets its own prices, availability, and cancellation policies, which are displayed before you confirm a booking.

Cancellation and refund eligibility for a booking is governed by the applicable Facility's cancellation policy. WooFur may facilitate refunds but is not obligated to provide them beyond what the Facility's policy allows.

You authorize WooFur and its payment processors to charge your selected payment method for bookings and applicable fees. Prices are quoted in US dollars unless otherwise stated.

5. Pet Health and Safety

Pet Parents are responsible for providing accurate and complete information about their pets, including vaccination records, medical conditions, medications, behavioral history, and emergency contacts.

Facilities may require proof of vaccinations and may decline or terminate services for pets that pose a health or safety risk. Pet Parents remain responsible for their pets at all times, including for any damage or injury caused by their pets.

In an emergency, you authorize the Facility to seek veterinary care for your pet, and you agree to be responsible for associated costs, as described in the Facility's policies.

6. Facility Responsibilities

Facilities are independent businesses and are solely responsible for the services they provide, compliance with applicable laws and licensing requirements, the conduct of their staff, and the accuracy of their listings.

Facilities must maintain any insurance required by law and are encouraged to carry liability insurance covering the services they offer through the Service.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) post false, misleading, or fraudulent content or reviews; (c) harass, abuse, or harm other users; (d) interfere with or disrupt the Service or its infrastructure; (e) scrape, copy, or reverse engineer any part of the Service except as permitted by law; or (f) circumvent booking or payment processes, including by transacting off-platform with users you met through the Service.

8. Reviews and Content

You retain ownership of content you submit to the Service (such as reviews, photos, and pet profiles). By submitting content, you grant WooFur a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and promoting the Service.

We may remove content that violates these Terms or that we reasonably consider objectionable.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WOOFUR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, AND MAKES NO GUARANTEES ABOUT THE CONDUCT, QUALITY, OR SAFETY OF FACILITIES OR OTHER USERS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOOFUR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY SERVICES PROVIDED BY FACILITIES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOOFUR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO WOOFUR IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless WooFur from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, Facilities, or WooFur. You may stop using the Service and request account deletion at any time.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
